Such as SIM cards, SMS headers, and international mobile equipment identity (IMEI), among others.

Criminals Using SIM Cards for Fraudulent Activities

The government has noted that criminals often acquire SIM cards or other telecommunication identifiers, like SMS headers. To send bulk messages to citizens through fraud, deceit, or impersonation. Additionally, some individuals obtain SIM cards in their names and then give these cards to others for use. This practice can lead to cyber fraud, making the original user liable as well, according to the Department of Telecommunications (DoT).

This is an offense under the Telecommunication Act of 2023. There have been instances where Point of Sale establishments have facilitated such procurements, which constitutes abetting the offense,” the DoT stated in a release.

Punishment for Violating the Telecommunication Act 2023

Under Section 42(3) of the Telecommunication Act 2023, offenses are punishable by imprisonment for up to three years, a fine of up to Rs 50 lakh, or both. This provision seeks to deter violations that threaten telecommunications integrity. Section 42(6) further imposes the same penalties on those who abet these offenses, ensuring that all participants in such activities are held accountable.

IMEI, IP Addresses, and SMS Headers Being Altered

Recently, there have been reports of individuals tampering with telecommunication identifiers. Such as the Calling Line Identity (CLI), commonly known as the phone number, using various methods including mobile apps. Other identifiers that uniquely identify a user or device—such as IP Address, IMEI (Mobile Handset Identifier), and SMS headers—are also being manipulated to send fraudulent messages. According to the Department of Telecommunications (DoT).
